FUSION BEADS REWARDS PROGRAM TERMS AND CONDITIONS

Subject to the terms and conditions set forth below, Fusion Beads Rewards Program (“Rewards Program”) members (“Members”) will earn points in connection with the purchase of qualifying products at www.fusionBeads.com (the “Website”) and other activities that are redeemable towards the purchase of qualifying products.
IF YOU DO NOT AGREE TO ALL OF THESE FUSION BEADS REWARDS PROGRAM TERMS AND CONDITIONS, OR IF YOU ARE NOT ELIGIBLE OR AUTHORIZED TO ENTER INTO THIS AGREEMENT, THEN DO NOT ACCESS, USE OR PARTICIPATE IN THE REWARDS PROGRAM. ACCESSING OR USING ALL OR ANY PART OF THE FUSION BEADS REWARDS PROGRAM WILL CONSTITUTE ACCEPTANCE AND CREATE A LEGALLY ENFORCEABLE CONTRACT UNDER WHICH YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
1. Enrolling in our Rewards Program
All eligible users of our Website who register an online account with FusionBeads.com® are automatically enrolled in the Rewards Program. To register an online account with FusionBeads.com®, users must provide their full name and email address and create a password. No purchase is necessary to enroll in the Rewards Program.
2. Rewards Program Privacy; Opt-In Required for Rewards Program Emails; How to Unsubscribe
Enrollment in the Rewards Program does not automatically sign Members up for Fusion Beads Rewards Program emails or other Fusion Beads offers and promotional emails. Members must separately opt in to receive these emails. If you have subscribed to these emails and wish to unsubscribe, either click the “unsubscribe” link in any one of these emails or contact us with your request to be unsubscribed by emailing us at email@example.com or calling us at 1-206-781-9500 or toll free at 1-888-781-3559.
You must be age 18 years or older and a resident of the United States to be eligible for membership in the Rewards Program. Membership in the Rewards Program is limited to individuals only; corporations, associations, and other groups are not eligible.
Members are limited to one account per individual. The Rewards Program is void where prohibited by law. Do not participate in the Rewards Program if it is not legal to do so in your jurisdiction.
If it is determined at any time, at Fusion Beads’ sole and absolute discretion, that you do not meet the eligibility criteria, your Rewards Program account will immediately terminated and all rewards points and rewards cash will be forfeited.
4. Cancellation of Your Rewards Program Account
You may cancel your Rewards Program account at any time by sending an email to firstname.lastname@example.org. Fusion Beads will cancel your Rewards Program account within 48 hours of receiving such request from you. Upon cancellation, any unused rewards points or rewards cash accrued in your Rewards Program account will be forfeited and cannot be redeemed.
Unless we have terminated your FusionBeads.com® account or Rewards Program account, you may rejoin the Rewards Program after you cancel your membership by emailing us at email@example.com or calling us at 1-206-781-9500 or toll free at 1-888-781-3559.
5. Changes to Rewards Program
We reserve the right, in our sole discretion, to modify, cancel, or restrict the Rewards Program terms and conditions at any time, including, without limitation, the manner in which Members earn rewards points or rewards cash, the amount of rewards points or rewards cash earned for a given purchase or activity, and the manner in which Members may redeem rewards points or rewards cash. The updated Rewards Program terms and conditions will be effective as of the time of posting unless otherwise specified by Fusion Beads.
Any changes can be made without advance notice to you, but we will use reasonable efforts to notify you of any material change by posting them to this page, and we may also notify you by email to the address associated with your FusionBeads.com® account. Fusion Beads may make these changes even though such changes may affect your ability to use rewards points or rewards cash that you have already accumulated. Fusion Beads may limit the number of Rewards Program participants and may temporarily or permanently discontinue registering new participants at any time and for any reason without notice to you.
Your continuing use of the Rewards Program after notification of any change(s) (including notification by posting) constitutes your agreement to be bound by the terms and conditions, including any such change(s).
If any provision in the Rewards Program terms and conditions is found invalid, void, or for any reason unenforceable, that provision is severable and does not affect the validity and enforceability of any remaining terms, changes or conditions, all of which shall remain in full force and effect.
It is your responsibility to check this page regularly for any changes to the Rewards Program terms and conditions. If you do not agree to the Rewards Program terms and conditions or any changes thereto, your sole remedy will be to terminate your Rewards Program account by emailing us at firstname.lastname@example.org or calling us at 1-206-781-9500 or toll free at 1-888-781-3559.
6. Earning Rewards Program Points and Rewards Cash; Changes in Rewards Program Structure
Under the Program, a Member can earn rewards points and rewards cash once the Member makes a Qualifying First Purchase. A Member’s “Qualifying First Purchase” is the first order the Member places for non-gift certificate items following March 11, 2019—the launch date of the Rewards Program. For the sake of clarity, an order placed solely for gift certificates does not constitute a Qualifying First Purchase; the order must contain at least one non-gift certificate item to constitute a Qualifying First Purchase.
Following the Qualifying First Purchase, the Member can earn points as follows:
1. Members will earn one point for each full US dollar the Member spends on qualifying products. For example, if you spend $29, you will receive 29 points;
2. Each New Member will earn 50 points on the Member’s Qualifying First Purchase;
3. Members will earn five points for each the following, subject to specified limits:
3a. Writing a review of a product on FusionBeads.com® (up to ten points—two reviews—per month)
3b. Sharing a FusionBeads.com® product or project on a social media platform (Facebook, Pinterest, or Twitter) (up to ten points—two social media shares—per month)
3c. Watching FusionBeads.com® videos (up to ten points—two videos—per month)
4. Fusion Beads may offer other opportunities to earn points at its sole discretion; 5. For every 200 points that a Member earns, Fusion Beads will reward $5 (five dollars) in rewards cash that a Member by then apply to qualifying purchases.
Any rewards points or rewards cash earned from a qualifying purchase or other qualifying activity will be reflected in your Rewards Program account within 24 hours of order billing.
As described in greater detail below in the section titled “Expiration of Rewards Points and Rewards Cash,” rewards cash expires 90 days after the rewards cash is accrued, and rewards points expire one year after the Member’s Anniversary Date, as defined below.
7. Expiration of Rewards Points and Rewards Cash
Rewards Cash Expiration. Once a Member accumulates 200 points, the rewards points are converted to $5 rewards cash in the Member’s account. Upon accruing rewards cash, the Member will have 90 days in which to redeem the rewards cash through a qualifying purchase on FusionBeads.com®.
Rewards Points Expiration. Members will have up to one calendar year from the Member’s Anniversary Date to earn sufficient rewards points to accrue rewards cash. The “Member’s Anniversary Date” is the month and day of the Member’s First Qualifying Purchase (defined above). If a Member has not accumulated enough points to reach a 200-point increment (thereby earning rewards cash) within each year beginning on the Member’s Anniversary Date, the Member’s rewards points will expire.
By way of example only, if, following enrollment in the Rewards Program, a Member makes her first purchase of $260 for non-gift certificate items on March 9, 2019, the Member’s Anniversary Date is March 9. In the first year of the program, the Member has until March 8, 2020 to accumulate 200-point increments and associated rewards cash. The March 9, 2019 purchase earns 310 points (one point per dollar spent plus 50 points for the Member’s first purchase), which is reflected in the Member’s rewards account as $5 in rewards cash (the rewards cash earned for 200 points), and a points balance of 110 points (i.e., 310 points less the 200 points that have been converted to rewards cash in her account). She has until June 7, 2019 (90 days from March 9, 2019) to redeem her $5 in rewards cash. On June 8, 2019, the rewards cash will expire; on that date, the Member’s account will reflect $0 in rewards cash and a points balance of 110 points. In order to earn another $5 in rewards cash, the Member will need to accumulate 90 more points before the Member’s Anniversary Date (March 9, 2020). If the Member does not make another qualifying purchase by March 8, 2020, then her points will expire, and on March 9, 2020, she will have 0 points. She then has until March 8, 2021 to earn more rewards cash by accumulating at least 200 points.
Shipping Charges and Taxes. Calculation of Rewards Program points excludes payment by the Member for shipping charges and all taxes, including without limitation, federal, state, and local taxes or use taxes.
Purchases of Gift Certificates. Purchases of gift certificates are not eligible for rewards points. However, purchases made in whole or in part by using a gift certificate will earn rewards points on the amount of the purchase, subject to these Exclusions.
Discounts and Promotional Gifts. Rewards Program points will not be earned on any discounts or other credits offered in connection with any product. By way of example only, if a product that is normally $10 is on sale for $7, a Member will only earn rewards points on the purchase price of $7. If a Member purchases a product that comes with a promotional free product, rewards points will not be issued on the retail value of the free product.
Other. Rewards points accumulated on different Members’ accounts may not be combined or aggregated for any reason. Points earned in a transaction cannot be redeemed in the same transaction. All purchases made: (i) by a Member prior joining the Rewards Program or (ii) without the Member being logged onto the Member’s account are not eligible for Rewards Program points.
9. Redeeming Rewards cash
Once a Member accrues rewards cash as described above, the Member may redeem the rewards cash on purchases of qualifying products at FusionBeads.com®. To redeem rewards cash, click the button labeled “Redeem Rewards Cash” on step 2 of the checkout process. You must be logged in to your FusionBeads.com® account to redeem rewards cash.
Points may be redeemed on the purchase price of qualifying products only and cannot be used towards the payment of sales tax or shipping and handling charges or for the purchase of gift certificates.
10. Purchases Made Using a Gift Certificate
When a Member makes a qualifying purchase using a gift certificate, the Member will earn points on the amount of the purchase, subject to the Exclusions above. However, rewards cash cannot be used towards the purchase of gift certificates.
Rewards points and rewards cash earned for a purchase that is subsequently returned or refunded, in whole or in part, will be deducted from the Member’s Rewards Program rewards points and/or rewards cash balance in an amount equal to the rewards points and/or rewards cash earned for the items in the original transaction. By way of example only, if a Member purchases several items totaling $210 and subsequently returns $50 worth of those items, the Member will initially earn 210 points ($5 rewards cash and 10 rewards points in a remaining points balance), and upon return 50 points will be deducted from the Member’s Rewards Program account, resulting in removal of the $5 rewards cash and a remaining points balance of 160 points (210 points minus 50 points for returned items). Adjustments to rewards points and rewards cash will be made to your account within 24 hours of processing your return.
12. Accessing Rewards Program Information
Once you are a registered user of FusionBeads.com®, you may view your rewards points balance and available rewards cash by logging onto your account at FusionBeads.com®, clicking on the “My Account” link in the header of the website homepage, and then clicking on the “Rewards” link on the left side navigation of the “My Account” page.
13. Rewards Program Code of Conduct
You agree not to take any action or upload, post, submit or otherwise distribute or facilitate distribution of any content (including text, communications, software, photographs, videos, sound recordings, data or other information) using any communications service, product review field, survey, feedback or other service available on or through FusionBeads.com® or the Rewards Program, including third party social media platforms such as Facebook, Twitter, or Instagram, in any manner, that:
• infringes any patent, trademark, trade secret, copyright, right of publicity, privacy right or other right of any party;
• reveals any personally identifiable information about another individual, including another person’s name, address, phone number, electronic mail address, credit card information or any other information that could be used to track, contact or impersonate that person;
• constitutes unauthorized or unsolicited advertising, junk or bulk e-mail (“spamming”), or any form of lottery or gambling;
• imposes an unreasonable or disproportionately large burden on Fusion Beads’ website or Rewards Program operations;
• attempts to gain unauthorized access to the Rewards Program, other Members’ accounts, computer systems or networks connected to the Rewards Program, through password mining or otherwise;
• contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware or network system or to damage or obtain unauthorized access to any system, data or other information of Fusion Beads or any third party;
• creates FusionBeads.com® accounts or Rewards Program accounts by any automated means or under false or misleading pretenses;
• harvests, scrapes or collects any information from the Rewards Program;
• disguises the source of content posted; or
• impersonates any person or entity, including any employee or representative of Fusion Beads.
14. Unauthorized Activity and Access
You are solely responsible for keeping your Member information up to date, and for keeping your login credentials, email address and password confidential and for all activities—including unauthorized activities—that occur on your FusionBeads.com® account, including your Rewards Program account. Fusion Beads will not be liable for: (i) any Rewards Program points, credits, debits, or rewards cash redemptions made in connection with your Rewards Program account, (ii) any loss or damage arising from your failure to adequately safeguard your login credentials; or (iii) errors caused by incorrect Member information. You agree to immediately notify Fusion Beads of any unauthorized use of your login credentials or Rewards Program account or any other breach of security related to the Rewards Program.
15. Disputes Relating to Rewards Program
A Member’s rewards points and rewards cash balance, as reflected in Fusion Beads’ records, shall be deemed correct. Fusion Beads will determine the amount of rewards points and rewards cash in a Member’s account based on our and our third party service providers’ records related to such Member’s account. All questions or disputes regarding eligibility for the Rewards Program, collecting or redemption of rewards points or rewards cash, or your compliance with the Rewards Program terms and conditions will be resolved by Fusion Beads, in its sole and absolute discretion.
